As of February 1, 2006 Congress passed changes to the Title XIX laws extending the "look-back" period to five (5) years. Even more important, changes were made to eligibility rules which can result in ineligibility if ANY transfers were made during the five year period. None of the changes are retroactive, but persons applying for assistance after 2/8/06 face a complicated determination process. Title XIX laws are constantly being changed, so be sure to consult your attorney for greater detail and updated information. Some additional information is also available from the Department of Social Services website. Read their publication "LTC issues and Medicaid."
