Interesting Fact:

As of February 1, 2006 Congress passed changes to the Title XIX laws extending the "look-back" period to five (5) years. Even more important, changes were made to eligibility rules which can result in ineligibility if ANY transfers were made during the five year period. None of the changes are retroactive, but persons applying for assistance after 2/8/06 face a complicated determination process. Title XIX laws are constantly being changed, so be sure to consult your attorney for greater detail and updated information. Q. How long will my appointment be?

A. Real estate closings can take one to one and a half hours, depending on whether there is a bank transaction involved and how many mortgages are being taken out. Appointments for simple wills, living wills and Powers of Attorney take about one half hour for discussion and another half hour for document preparation and signing. Clients often leave with their completed documents.

Q. How will I be billed for my appointment?

A. Real estate transactions have flat fees:

Purchase - $675.00 plus the cost of the title search

Sale - $625.00

Refinance - $675.00 plus the cost of the title search or rundown

Commercial closings (purchase, sale & refinance) - $990.00 and up

Other transactions have the following fees:

Warranty, QuitClaim deed - $150.00

Will without a trust - $250.00 minimum

Will with a trust - $300.00 minimum

Living Wills - $70.00, price with will

Powers of Attorney - $70.00, price with will

Living Trust - $850.00 minimum

Lease - residential $200.00+, commercial $300.00+

Evictions - $550.00 minimum

LLC - $200.00 to $800.00

Incorporation - $400.00 to $1,000.00

Consultations on other matters are billed at the rate of $250.00 per hour.

Estate work is billed at the hourly rate or at a percentage of the estate, by agreement with the client, which will be determined before work begins.

Q. What do I need to bring to my appointment?

A. For a real estate purchase, bring a bank check made out to 'Jane R. Marsh Client's Fund' in the amount indicated to you prior to the closing. Also bring a photo ID. You will be notified prior to the closing if any other documents are required.

For a real estate sale, you will be notified prior to the closing of any items that are required. It is good to bring at least one key.

For a real estate refinance, bring a photo ID. You will be informed prior to the closing whether you need to bring a bank check, or if any documents are required by the bank.

If you are making changes to your Will, Living Will or Power of Attorney, please bring the originals of these documents if you have done them before, so they may be reviewed and then destroyed after the new ones have been executed. You should have the correct legal name and address of anyone you may wish to mention.

For estate work, please contact our office prior to your appointment so we may go over with you the items that will be needed

If you are a landlord calling about an eviction matter, please be prepared to email or fax a copy of the lease, along with the names of all adults living at the rented property and their social security numbers.
